These Terms & Conditions govern your access to and use of RestIQ, an AI operating system for restaurants provided by Abdullah Talal Almuzaini ("we", "us", "our" or the "Seller"). By signing up, accessing or using RestIQ, you agree to be bound by these terms. If you do not agree, do not use the service.
1. Seller information
RestIQ is operated by Abdullah Talal Almuzaini. You are entering into a contract with the Seller for the use of the RestIQ software platform.
2. Acceptance of terms
By creating an account, subscribing to a paid plan, or continuing to use RestIQ, you confirm that you have read, understood and agree to these Terms. If you are using RestIQ on behalf of a business, you represent that you have authority to bind that business.
3. Product description
RestIQ is a cloud-based software service for restaurants that provides inventory management, recipe costing, supplier management, purchase orders, invoice intelligence, analytics, AI recommendations and related tools. Features vary by plan.
4. Account and credentials
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information and keep it up to date.
5. Acceptable use
You agree not to misuse RestIQ. Prohibited conduct includes: unlawful use; fraud or spam; intellectual property infringement; interfering with security; introducing malware; probing or scraping; reverse engineering; circumventing technical limits; reselling or redistributing access; and uploading content you do not have rights to use.
6. Intellectual property
The Seller retains all ownership rights in RestIQ, including its software, documentation, branding, algorithms and content. We grant you a limited, non-exclusive, non-transferable right to use RestIQ within the scope of your selected plan.
7. User content
You retain ownership of the data and content you upload. You grant us a limited licence to host, process and analyse that content solely to provide and improve the service.
8. Service level
We aim to keep RestIQ available and reliable, but we do not guarantee uninterrupted or error-free performance. Scheduled maintenance and unexpected issues may cause temporary interruptions.
9. Payment, billing and subscriptions
Subscriptions are billed in advance through our online reseller, Paddle.com. Paddle is the Merchant of Record for all our orders, which means Paddle processes payments, taxes, billing, invoicing, cancellations and refunds on our behalf. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. 10. Renewal, cancellation and termination
Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You may cancel at any time through your account settings or by contacting Paddle support. We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations.
11. Warranties and disclaimers
RestIQ is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. AI-generated recommendations are advisory only and should be reviewed by a qualified person before operational decisions are made.
12. Limitation of liability
To the extent permitted by law, our aggregate liability is capped at the total fees paid by you in the 12 months before the claim. We are not liable for indirect, consequential or special damages, including lost profits, data or goodwill, except where liability cannot be excluded by law (such as fraud, death or personal injury).
13. Indemnity
You agree to indemnify and hold harmless the Seller from any claims arising out of your content, unlawful use of RestIQ, or breach of these Terms.
14. Governing law and disputes
These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any dispute shall be resolved in the competent courts of Riyadh, Saudi Arabia, unless otherwise required by mandatory local law.
15. Assignment and force majeure
You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for failure to perform due to events beyond reasonable control, including internet outages, natural disasters or government actions.
16. Changes to these terms
We may update these Terms from time to time. Continued use of RestIQ after the changes take effect constitutes acceptance of the revised Terms.
